McBlurb reserves the right, at its sole discretion, to modify or amend these Terms of Use which are a binding contract between McBlurb.com (“McBlurb” or “McBlurb.com” or “we” or “website” or “site” or “us”) and you (“you” or “user” or “visitor”). Read the entire Terms of Use (“Agreement” or “Terms”) before using the McBlurb website. Your continuing use of our website, McBlurb.com, constitutes your binding acceptance of these Terms of Use and our Privacy Policy, including any changes or modifications made by McBlurb. By using our website, you agree to follow all policies and guidelines that McBlurb may provide you or publish on the website. These terms apply to all users of the website which include registered members and visitors of the McBlurb website. By accessing McBlurb, you accept and recognize, without limitation, the Terms, Privacy Policy, and WPP Terms of Use. To become a user you must agree and accept these Terms while indicating your acceptance at the time of registering. If at any time, these Terms of Use, the Privacy Policy, and/or the WPP Terms or Use are not acceptable to you, you should entirely cease using our website.

1. Website & Terms Modification: McBlurb reserves all rights to periodically modify and/or discontinue the McBlurb website at any time without notification to users or visitors. We also reserve the right to block access to the website from users and visitors at any time without any notice or warning. We also reserve rights to change or remove your works of authorship, text, pictures, graphics, images, likenesses, and personal information (all together, “Content”) from our website at any time without any notification to you, other users, or visitors. Modification or removal of your content may be temporary or permanent. McBlurb will not be liable to any third party or you for any such modification, discontinuance, suspension, blocking, restriction, or removal of the website and any such action by McBlurb will not affect McBlurb’s license to your Content as stated herein.

All McBlurb’s visitors and users agree that periodically we may modify, change, or remove all or any sections of these Terms, the Privacy Policy, and the WPP Terms of Use. Such modifications will be at our sole discretion and immediately effective upon McBlurb’s posting of these modifications to our website. If these Terms are modified, McBlurb will post the new Terms and the effective date on our website. It is strongly recommended that all users and visitors check back regularly to check for any modifications. Continuing to use the website, following modifications to the Terms of Use, declares your acceptance of any such changes.

You agree that, McBlurb may change, add, delete, terminate, and/or cancel your account, articles, and access to the website at our sole discretion and anytime. If applicable law requires us to provide you with notice of such termination and/or changes, then McBlurb may post such notice on our site or email you such notice. Any breaches of these Terms and/or obligations incurred before the Terms end still makes you liable.

2. About McBlurb: McBlurb is an article website in which registered users can post as many articles as they wish which include, but are not limited to, news, instructional, opinion, and factual articles. All users and visitors have access to all articles posted by McBlurb or any of its users. Our articles will be published by a very wide range of demographics and can include a variety of opinions or expertise. Users can display their perspectives and expertise on a variety of issues by posting an article on that topic. McBlurb is website where people can share ideas, expertise, knowledge, and views with the world. As a website designed to help you display your ideas and Content, we, in return for that display, for any given period of time, you agree to grant the license to McBlurb described in the next section (Section 3) hereof. McBlurb gives our users a variety of features to use on our website. We give and encourage all users to create personal profiles which other users can view. We encourage all users to submit, read, and comment on articles.

3. License Rights and Ownership of Rights: You grant McBlurb non-exclusive rights to any Content you post to the McBlurb website and McBlurb does not limit you from granting similar rights to others. You still retain ownership of your copyrights, any other proprietary rights, and intellectual rights for any Content you post to the McBlurb website. You hereby grant McBlurb a completely freely transferable, royalty-free, freely sublicensable (through infinite levels of sublicense), worldwide, non-exclusive license to use your Content, reproduce Content, change or modify Content, communicate Content, deliver Content, publicly perform and display such Content. You also grant McBlurb the exclusive right to create borrowed works of the Content, in any form, media, or technology, which are currently known or may be developed at a later time. Under the laws of any jurisdiction, you hereby waiver any moral rights you may have in such Content. By agreeing to these terms of use, you give McBlurb complete power to join and complete any document or do anything we consider fit to validate consents, agreements, assignments, grant of rights, and waivers set forth in McBlurb’s Terms.

All users and visitors agree that we have the right to display your content or not display your content. You also agree that we have the right to display your username or real name, depending on your preferences, in addition to your Content. You agree that publishing of your Content on the McBlurb website for any amount of time is enough for the license granted herein to McBlurb. Joining the Writers Payment Plan is your decision. Joining McBlurb’s Writers Payment Plan, which is described more so in section 5 of this Terms of Use document, does not mean your Content will generate money for you. Generating money or not generating money will not affect any license granted to McBlurb. McBlurb grants you permission to remove or change any Content that you have posted on our website but if before you changing or removing such Content, McBlurb has made specific plans to make any materials containing such Content for advertising, promotion, or otherwise, then you agree that McBlurb may continuing using such Content even after your removal or modification of that Content. 4 months after you have removed or changed such Content, you have the option to send McBlurb a notice to stop using such Content in which case, McBlurb will stop using such Content within 45 days of delivery to us of your notice.

4. Age Requirement: By signing up to become a registered user and using our website you are warranting and stating that you are at least 18 years of age and of legal age to form a binding contract. By signing up to become a registered user and using our website you hereby ratify any prior grant of rights, agreements, assignments, consents, and waivers made by you. If you create a McBlurb account, you must be the only user of such account. McBlurb is to be used by people who are at least 18 years of age, or at least the legal age that is required to form a binding contractual agreement in your individual jurisdiction if that age if greater than 18.

5. McBlurb’s Writer Payment Plan (“WPP”): To join McBlurb’s WPP you must be a legal resident of the United States of America and meet all eligibility requirements. The WPP is a payment plan which allows writers to earn money for their Content on McBlurb. To join the WPP you need to register on our website, provide us with your tax information, and agree to the WPP Terms of Use, Terms of Use, and Privacy Policy. The WPP Terms of Use are part of and fused into these Terms. You hereby grant McBlurb permission to change or suspend any or all parts of the WPP at our sole discretion. You agree that McBlurb is not liable to any third party or you for changing, modifying, or suspending any or all parts of the WPP, at any time. If any Terms are modified, McBlurb will re-post the new Terms, the effective date, and may or may not re-present the new Terms as you are logging into our website. Any modified Terms will be effective upon posting to the McBlurb website. By staying signed up for the WPP and participating in the WPP, after the modified Terms have be posted, you are agreeing to the binding Terms of the McBlurb website. If these new Terms are not acceptable then your only form of recourse is to quit participating in McBlurb’s WPP.

6. Content Posting on McBlurb: To publish or post content on McBlurb, you must register with our Site and create an account. You agree to provide truthful information during the registration process. You agree to maintain accurate information in your account. You agree that we can rely on the information you have provided us and you also agree that your account in non-transferable and non-assignable. By publishing, posting, inserting, displaying, and broadcasting any Content on the McBlurb website, such as, but not limited to, text, pictures, graphics, images, personal information, and any other works of authorship and including any Content you post through the WPP, you represent and warrant that you have ownership of all rights in your Content. You also agree you have acquired all necessary rights to such Content to enable you to grant to McBlurb the right in your Content described in these Terms of Use. You agree that you have paid all necessary license fees to post certain Content. You agree that you will not breach on intellectual property rights, privacy, or any other moral or legal rights to any third party.

McBlurb is not liable to you, any third party, or anyone else for any injury or loss due to your access of our website or due to you following the advice of one of our “how-to” articles. Authors of Content are solely liable for such Content. All users should consult a professional before following any advice provided on McBlurb.com.

You agree that you are the owner of all posted Content or have obtained permission from every owner of a piece of work. You agree to keep records to prove your content does not violate any warranties and/or anyone else’s intellectual property or other rights.

7. Banned, Prohibited Content, and Prohibited Conduct: You agree to not post anything infringing on another person’s or entities copyrights, trademarks, patents, any third parties intellectual property rights, or any other proprietary rights of any party. You are not allowed to post any advertising, computer code, files, viruses, any Content which is in violation of any applicable local, state, national or international laws, and any content that is not your original work or work you do not have permission to publish. You agree to not post inside information or confidential information of any third party. You agree to not post any Content that could be offensive, racist, untrue, threatening, harassing, distasteful, evil, horrid, vulgar, obscene, defamatory, pornographic, x-rated, hateful, and provide another person’s personal or protected information. You agree to not to post articles with excessive outward links or excessive self-promotion of your own business or website. All articles should be written to teach others how to perform a particular task. McBlurb has the right to immediately delete any prohibited and/or banned content which you may attempt to post on our website. McBlurb may also delete any Content that we feel may be inappropriate, in our sole discretion. Posting such content may lead to deletion of your account and an overall banning of use of the McBlurb website. You grant McBlurb the right to delete any content it sees fit even if it is not listed in these Terms.

Your articles must include a link to referenced source. All articles must be original work and will be deleted if found to be not your original work. Submitting content which is stolen from someone else will lead to your account being banned. If you include a picture which is not royalty free or a photo which you do not have permission to use, you should include the source (URL) of where you got the photo from. You should also provide the link for any sources you use in writing your article.

You agree not to violate any laws, tamper with the website in areas you are not authorized to be in, alter information on the website, use robots or other automated means to extract data, access the website, spam, or transmit unsolicited advertising, make it appear as if you have a relationship with McBlurb, misrepresent your identity, copy website coding, discover source code, use viruses or harmful software to impact the website, and take any action to harm the websites infrastructure or systems which will be determined by McBlurb.

8. McBlurb Website Content Protection & Monitoring: The McBlurb website is protected by intellectual property laws. You agree and recognize the intellectual property laws that McBlurb is protected by. All Content may be displayed for your personal, noncommercial use. All Content is provided on an “as is” basis. There are no warranties of any kind, express or implied. McBlurb makes no warranties, express or implied, with regard to the Site, its operation, or your use of the Site, including but not limited to warranties of merchantability or fitness for a particular purpose. Any and all Content is not a substitute for professional advice.

We reserve the right to modify and delete Content at any time without notification. We are under no obligation to monitor the Content on the McBlurb website. You agree to let McBlurb send notices via email or any other form as McBlurb deems appropriate. You agree to look for notices on the McBlurb website. If such notices are posted, it is assumed you have gotten such notices.

Indemnity: You agree to hold McBlurb, our website, McBlurb.com, and any officers, directors, employees, agents, accountants, attorneys, consultants, developers, designers, and Content providers harmless from, and indemnify them for all costs, damages, expense, and any other liabilities as a condition of you using and accessing our website, violating our Terms, and/or improperly using McBlurb.com and its functions. Also, you agree to hold McBlurb harmless from all attorney fees and expenses.

13. Merchant Advertisers: McBlurb contains offers, links, and advertisements to websites of third parties which McBlurb does not control. These links and advertisements help McBlurb earn revenue and pay writers. McBlurb would not be possible would these third party links and advertisements. All links and advertisements may or may not be entirely accurate. You agree and recognize that McBlurb is not liable or responsible for any of the following for the correctness and/or accuracy of such advertisements or resources and the content of such advertisements and resources. We do not endorse any linked website and that websites content. Having these links and advertisements on our website in no way implies that we endorse such ad or link in any way. You click on and use links at your own risk. Our Privacy Policy and Terms of Use apply to our website and are not related to any other site that McBlurb may have a link to. You agree that all transactions will be conducted electronically from beginning to end. McBlurb may decide to process transactions non-electronically and you will still be governed by the remainder of these Terms. If we ever have to make transactions non-electronically, we reserve the right to charge or raise fees. You are responsible to comply with applicable local laws. No agency, partnership, joint venture, franchisor-franchisee, or employee-employer relationship is created by the Terms of Use. If any part of these Terms of Use is held by a court to be invalid then the invalid part will be given validity to the greatest extent. All other Terms of Use will still apply.

20. Trademarks and Copyrights: The trademarks of McBlurb and all other trademarks used in the website are owned or used under license by McBlurb. You may not use any of the above trademarks or any trademarks displayed on this website or in any website Content. The names of any third parties and their products mentioned may be their trademarks. All rights are reserved.

All content on the McBlurb website is subject to intellectual property rights, contractual or other protection. The intellectual property rights are owned by McBlurb or our licensors. No content can be republished, copied, uploaded, distributed, transmitted, or re-posted in any way.

Writer’s Payment Plan (WPP) Additional Terms of Use

Effective: April 5, 2009

By joining the Writer’s Payment Plan (“WPP”), you are bound and agree to follow these WPP Additional Terms of Use, along with the Terms of Use, and Privacy Policy which may be modified from time to time (“WPP Terms”). If you do not agree, recognize, and accept these WPP Additional Terms of Use, you are not permitted to register and participate in the WPP and therefore will not receive any compensation for the articles you post on McBlurb.com.

The Writers Payment Plan (WPP) – The WPP lets our writers have an opportunity to earn money from the articles they post onto to the McBlurb website. Writers earn money based on the number of views they receive, how popular their articles are (many comments/responses, high rating, and etc.), number of articles written, and the quality of their writing. McBlurb.com gives everyone a chance to earn money by writing articles. McBlurb will also occasionally give bonuses to certain writers who win certain contests set by us. McBlurb helps people earn extra money for bills, groceries, luxuries, and etc. and we are proud to be a source of extra income for people. By participating in our WPP, you agree and recognize that McBlurb determines, in its sole discretion, the amount of money you earn for the articles that you post, if any money at all.

Eligibility - To participate in our Writer’s Payment Plan, you must meet all eligibility requirements. McBlurb reserves the right to deny you access to register/join the WPP and/or eliminate your current WPP, account any time, in its sole discretion. To join and participate in the WPP, you agree to and recognize the Terms of Use, Privacy Policy, and the WPP Additional Terms of Use, at all times, along with any other policies or guidelines McBlurb may post on its website. You must be at least 18 years old and be a legal resident of the United States. Also, you must be the legal age required to form a binding contract in your jurisdiction if that age is older than 18. You must have a valid social security number or a valid employer identification number. To join the WPP program, you must complete the WPP registering process on McBlurb.com. You agree to provide accurate and complete information during the registration process. You must provide a valid social security number or employer identification number for tax reporting purposes. You must complete a W 9 for the Internal Revenue Service and have a valid PayPal account, bank account, or other payment system which is acceptable to McBlurb under the WPP. You agree to maintain updated information, such as, email, address, name, tax information, and anything else McBlurb requires during the signing up process. You agree that McBlurb has no liability to you or any third party for any failures to make payments because of you not providing accurate or complete information in your WPP Account. You may be eligible under McBlurb’s WPP to earn money for the how-to articles you post on McBlurb provided that such how-to articles do not contain any prohibited or banned Content as listed in McBlurb’s Terms of Use. By registering for the WPP, you agree that all of your previously posted and newly posted how-to articles are eligible to earn you money. McBlurb is under no obligation to monitor your articles/Content and may, at its sole discretion, determine that certain posted Content/articles will not be eligible for compensation.

Rights, Disclaimer of Warranties, Limitation of Liabilities & Misc info - McBlurb reserves the right to change or fully cancel the WPP, at any time, for any reason, and in its sole discretion. McBlurb will notify writers through email or will post a notice on the website, prior to any canceling of the WPP, if applicable law requires us to do so. We will not be responsible for not notifying you of any canceling or changing to the WPP program if you have provided McBlurb with inaccurate email, do not check your email, and/or provided McBlurb with an inaccurate address. To terminate your participation in the WPP, please fill out the Contact Us form and let us know why you are leaving. You account will be deleted within fourteen (14) business days of us receiving your request. McBlurb can delete your account at any time, in its sole discretion, if you die, provide inaccurate/incomplete information, breach our Terms of Use, Privacy Policy, and/or WPP Additional Terms of Use, in addition to any new Policies or Terms McBlurb may post to the McBlurb website or email to you. If your WPP account is terminated by McBlurb for other reasons other than failing to comply with the Terms of Use, WPP Additional Terms of Use, and/or Privacy Policy, then McBlurb will pay you your remaining balance within one-hundred (100) days after your WPP Account has been terminated. If your account is terminated because you failed to comply with the Terms of Use, Privacy Policy, and/or WPP Additional Terms of Use, then you will not be paid any of your remaining balance; it will be forfeited.

Taxes -You are solely responsible for all taxes which may be applicable, such as, federal, state, local, and foreign taxes or charges imposed by any government entity, directly or indirectly, in connection with your registering and participating in the WPP. In any year that payments are made to you of at least ten U.S. dollars (US $10.00), McBlurb will file an IRS Form 1099 and/or any other tax forms that may be required by the relevant government authorities. For McBlurb to comply with its U.S. federal income tax reporting requirements, you must agree to complete an IRS Form W 9 accurately and completely after you enroll in the WPP program. McBlurb reserves the right to withhold or reduce payment amounts which are appropriate to pay U.S. federal income tax, if you do not provide accurate or complete tax information. You agree to update and continually maintain the information you provide on the IRS Form W 9 to ensure completeness and accuracy at all times.

WPP Payments and Earnings - You may accrue earnings throughout the month. At the beginning of each calendar month you will be paid for the previous month (if earnings are over $10). If earnings are under ten dollars (US $10.00) then that balance will be forwarded to the next month. You are not eligible to receive any payments until you have earned a balance of at least $10. At the end of the calendar year, McBlurb will distribute earnings which are at least $1 and less then $10, minus a $1 nonrefundable processing fee. If your account has earnings of less than $1 at the end of the calendar year, you will forfeit those earnings and your earnings will be reset to $0 (zero dollars). All payments made to you by McBlurb will be in U.S. dollars and will be sent to your PayPal account or a different payment system which has to be acceptable by McBlurb. You will not receive late charges or interest on any payments or earnings. To be paid, you must maintain accurate and complete information in your Account.

McBlurb has no obligation to pay you any of your earnings and may deduct earnings, in our sole discretion, if we suspect or determine that you are improperly attempting to increase earnings from your articles by repeated manual clicking of advertisements, using robots to increase page impressions, third-party services, requesting for end users to click advertisements, using deceptive software, artificial click systems and page view systems which increase traffic to your articles, and any other unethical ways of increasing traffic/advertisement clicks.

McBlurb reserves the right to delete, suspend, withhold earnings, and disqualify you from your WPP Account if it suspects any unethical behavior and/or if you violate any of the Terms of Use, Privacy Policy, and/or WPP Additional Terms of Use. If you dispute any payment made by McBlurb, notify us by filling out the Contact Us section of the website within thirty (30) days of receipt of such payment. Not notifying McBlurb within 30 days will result in you waiving any claim relating to such dispute. McBlurb will always act in the most ethical manner and will use reasonable efforts to resolve any and all disputes. Once McBlurb has resolved a matter it will be binding upon you.
